This case is brought before this court, by an appeal from the decree of the circuit court of Georgia.

From the evidence in the case, it appears that Archibald M'Learn purchased a tract of land in the state of Georgia, on which he established a rice plantation, paid a part of the purchase money, and suffered a judgment to be obtained against him for the balance...
