Mr. Justice NELSON stated the facts and delivered the opinion of the court.

The judgment was rendered on the 10th of November, 1867. The writ of error was sued out the 19th, returnable the first day of the next term, which was the 2d day of December, a supersedeas bond given on the 29th of the same month, which was in time, excluding Sunday. The case thus far is within the cases of Villabolos v. United States, and United States v. Curry,
