CAMBERLING, v. McCALL.

Supreme Court of Pennsylvania.

December 1, 1798.


THIS cause (see 2 Vol. 280.) being again called on the list of arguments, THE COURT declared, that although they had proposed to the Defendant's counsel to wave the objection to the form of bringing the action, before the expiration of three months from the time of proving the loss; yet, that on his refusal to do so, they meant to decide in favor of the objection.

Judgment was, accordingly, entered for the defendant...
