{¶ 1} Plaintiff-appellant the State of Ohio appeals, pursuant to R.C. 2945.67, from a judgment convicting and sentencing defendant-appellee Steven Arnold. The State contends that the trial court erred by convicting Arnold of a fourth-degree felony rather than a third-degree felony.
