{¶ 1} This cause is before this court on remand from the Supreme Court of Ohio. In State v. Sutton, Cuyahoga App. No. 90172, 2008-Ohio-3677 (Sutton I), this court found that felonious assault and attempted murder were allied offenses of similar import and merged appellant's convictions for felonious assault and attempted murder as to each victim.
