APPEAL, by permission of an Associate Judge of the Court of Appeals, from an order of the Appellate Division of the Supreme Court in the First Judicial Department, entered May 31, 2022. The Appellate Division affirmed a judgment, as amended, of the Supreme Court, New York County (Ruth Pickholz, J.), which had convicted defendant, upon a plea of guilty, of burglary in the second degree.

People v Holmes, 205 A.D.3d 653, reversed.
