The judgment was affirmed by order of this Court entered April 30, 2021 (193 A.D.3d 1429 [2021]), and defendant on August 23, 2021, was granted leave to appeal to the Court of Appeals from the order of this Court (37 N.Y.3d 993 [2021]), and the Court of Appeals on November 17, 2022 reversed...
