Ordered that the judgment of conviction is affirmed.

Defendant was charged with unauthorized use of a vehicle in the third degree (Penal Law § 165.05 [1]), attempted petit larceny (Penal Law §§ 110.00, 155.25) and resisting arrest (Penal Law § 205.30).
