PEOPLE v. MARTINEZ

1586, 4277/11.

140 A.D.3d 624 (2016)

33 N.Y.S.3d 703

2016 NY Slip Op 05080

THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. JUAN MARTINEZ, Appellant.

Appellate Division of the Supreme Court of New York, First Department.

Decided June 28, 2016.

The verdict was not against the weight of the evidence (see People v Danielson, 9 N.Y.3d 342, 348-349 [2007]). There is no basis for disturbing the jury's determinations concerning identification and credibility. The evidence also supports the conclusion that property was taken from the victim during the incident.
