Ordered that the judgment of conviction is affirmed.

The People charged defendant with petit larceny (Penal Law § 155.25) and criminal possession of stolen property in the fifth degree (Penal Law § 165.40), alleging that defendant had entered a retail store with an empty store merchandise box, filled the box with merchandise taken from a store shelf, and obtained a refund of the price of the merchandise...
