The petition to invalidate a mechanics lien pursuant to Lien Law §201-a and to obtain possession of a vehicle cannot be determined on the papers submitted and hence a trial is necessary. Although not attached to the petition, this Court has previously issued a decision dated June 26, 2009, which denied a previous application and which granted petitioner leave to submit an amended petition.
