THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. JUSTIN MUNLYN, Appellant.

Appellate Division of the Supreme Court of New York, Second Department.

Decided November 24, 2009.

Ordered that the judgment is affirmed.

Contrary to the defendant's contention, the Supreme Court properly discharged a sworn juror based upon the juror's expressed inability to be fair and impartial as a result of his acquaintance with a prosecution witness (see People v Lennon, 37 A.D.3d 853 [2007]; People v Ford, 211 A.D.2d 438, 439 [1995]).
