Defendant pleaded guilty to the crime of sexual abuse in the first degree and was sentenced, as a second felony offender, to seven years in prison and five years of postrelease supervision. The Board of Examiners of Sex Offenders recommended that defendant be classified as a risk level three sex offender and, following a hearing, County Court adopted the Board's recommendation.
