Plaintiff, a tenant, is seeking a preliminary injunction, pursuant to CPLR and 6313, enjoining the defendant landlord from demolishing or otherwise impairing the "grand staircase" in the building in which plaintiff has leased commercial space. The plaintiff has brought this action seeking to have the staircase declared part of plaintiff's demised premises. Plaintiff initially sought a temporary restraining order, which was granted.
