ORDERED that the order is modified, on the law and the facts, by deleting the provision thereof denying that branch of the motion which was, in effect, to compel the plaintiffs to comply with Item No. 11 of the defendants' Notice for Discovery and Inspection dated November 16, 2006, and substituting therefor a provision granting that branch of the motion; as so modified, the order is affirmed insofar as appealed from, with costs to the defendants...
