This appeal arises out of a real property insurance dispute. Daniel Jones ("Plaintiff") appeals from an order dismissing his claims against J. Kim Hatcher Insurance Agencies, Inc. ("Hatcher") and HXS Holdings, Inc. ("HXS") (collectively "Defendants")1 pursuant to civil procedure rule 12(b)(6) for failure to state a claim upon which relief can be granted.
