This case is before us on remand from the North Carolina Supreme Court pursuant to the granting of the State's petition for writ of certiorari for consideration of the merits. The State appeals from an order dismissing two counts of capital first-degree murder against Gregory R. Chapman (defendant). In an opinion dated 7 February 2012, we dismissed the State's appeal on procedural grounds. Upon review once more, we vacate the order dismissing the indictments...
