Plaintiff appeals by right the decision of the Court of Claims granting summary disposition to defendant, the Parole Board, under MCR 2.116(I)(2) as the nonmoving party and denying plaintiff's motion for summary disposition under MCR 2.116(C)(8) and (10). We reverse.1
