On order of the Court, the motion for immediate consideration is GRANTED. The application for leave to appeal the April 28, 2011 judgment of the Court of Appeals is considered and, pursuant to MCR 7.302(H)(1), in lieu of granting leave to appeal, we REVERSE that part of the Court of Appeals judgment holding that the defendant asserted a claim of jurisdictional defect for which he need not demonstrate
