On July 22, 2008, Christian Castellon-Gutierrez, appellee, entered a guilty plea to the charge of robbery with a dangerous weapon. The Circuit Court for Montgomery County accepted the plea and, pursuant to the plea agreement, sentenced appellee to five years' incarceration, with all but time served suspended, and one year of unsupervised probation.
