In its petition, the Commonwealth sought relief from the denial, by a judge in the Superior Court, of its motion to disqualify John V. Monteiro's appellate counsel, Rosemary Scapicchio, on the ground that she has a conflict of interest due to her representation of both Monteiro and Michael Barros.
