This case requires us to determine whether G. L. c. 6, § 178H(a)(2) (§ 178H [a] [2]), permits an individual convicted of failure to register as a sex offender, subsequent offense, to be sentenced to a term of incarceration in State prison of less than five years. We hold that it does not.
