In State v. Thibeaux, 11-40 (La.App. 3 Cir. 5/11/11), 63 So.3d 1193, this court found the Defendant waived the right to appeal his five-year sentence by entering into a plea agreement with a sentencing cap. Rehearing is granted for the purpose of considering the correctness of this court's finding.
