Dan D. Plake appeals the district court's decision granting summary judgment in favor of Carla Casey. Carla had filed a petition requesting an accounting and distribution of sale proceeds of real estate in which she owns an undivided one-fourth interest. Plake, owner of one-half the real estate, had filed a counterpetition, claiming that he holds a 1976 judgment lien against the real estate which should be paid from the sale proceeds.
