STATEMENT OF THE CASE

Appellant-Plaintiff/Counter-Defendant, Robert A. Elrod (Elrod), appeals the small claims court's judgment in favor of Appellee-Defendant/Counter-Plaintiff, Larry Brooks (Brooks).

We reverse and remand for a new trial.
