JUSTICE GORDON delivered the judgment of the court, with opinion.

¶ 1 The underlying case concerns a dispute over petitioner Daewoo International's (Daewoo's) payment of allegedly $14.5 million to American Metals Trading, L.L.P. (AMT LLP) for pig iron that Daewoo never received. In respondent's brief to this court, he acknowledges that "Daewoo had paid for [the pig iron] but had not received [it]."
