¶ 1 The State charged and convicted the defendant, Jason Smith, with two counts of felonious aggravated driving under the influence (625 ILCS 5/11-501(a)(4), 11-501(a)(5), 11-501(d)(1)(C), 11-501(d)(2)(F) (West 2008)) and one count of misdemeanor driving under the influence (625 ILCS 5/11-501(a)(6) (West 2008)).
