JUSTICE PALMER delivered the judgment of the court, with opinion.

¶ 1 Following a bench trial, defendant Tom Tuduj was found guilty of first degree murder and disarming a peace officer. Defendant was sentenced to a term of 40 years' imprisonment for murder and to a consecutive term of 5 years' imprisonment for disarming a peace officer.
