On June 28, 2003, appellant Antonio Maurice Kitchens approached Nicky Samuels outside an Athens-Clarke County apartment complex, pointed a .9mm gun at Samuels, who was unarmed, and fatally shot Samuels as he tried to escape.1 Several witnesses saw the shooting and identified appellant as the shooter.
