This case arises out of an accident that occurred on February 21, 2004 outside Cartersville on Georgia Highway 61 involving a double tractor-trailer driven by Terry Stanton Lytle, an employee of ABF Freight Systems, Inc. ("ABF") and a delivery truck driven by Terry Warman, an employee of Schwan's Home Service, Inc. ("Schwan's").
