The state charged Joe T. Laseter with driving under the influence of alcohol to the extent that it was less safe for him to drive, driving with an alcohol concentration of 0.08 or more, and reckless driving. The trial court granted a directed verdict on the reckless driving charge. Laseter was found guilty by a jury of both remaining offenses, and the trial court merged the counts at sentencing.
