THIS MATTER comes before the Court on the Motion for Summary Judgment filed by Defendant AMJ, Inc. ("AMJ"). (Dkt. No. 90). Plaintiff DLJ Mortgage Capital ("DLJ") opposes the Motion (Dkt. No. 95),1 as does Defendant Schooner Bay Condominium Association ("Schooner Bay"). (Dkt. No. 94). For the reasons that follow, the Court will deny the Motion.
