This matter comes before the Court upon consideration of Defendant Shadae Cotton's Motion for Dismissal of Count Four of the Indictment or, in the alternative, Pretrial Election (Doc. # 84), filed on November 26, 2014. The Government filed a response in opposition to the Motion on December 10, 2014. (Doc. # 95). For the reasons that follow, the Motion is denied.
