This cause comes before the Court upon the Defendant John Cottam, M.D., P.A.'s1 Motion to Dismiss Second Amended Complaint for Lack of Subject Matter Jurisdiction (Doc. 11). Plaintiff John Herbold responded in opposition to this motion (Doc. 16). The Court, having considered the motion and being fully advised in the premises, will deny Defendant's Motion to Dismiss.
