Pending before the Court is Respondents' Motion for Summary Dismissal (Dkt. 21.) Respondents contend that Petitioner Hector Avila filed his Petition for Writ of Habeas Corpus beyond the statute of limitations expiration date and that the Petition should be dismissed with prejudice.
