MEMORANDUM OPINION

Presently before the Court is Defendant's Motion to Dismiss Plaintiffs Claims. (D.I. 8) Defendants filed the motion on June 3, 2013, and the Court heard oral argument on March 20, 2014. For the reasons discussed below, the Court will deny Defendant's motion.
