Pending is Respondent's Motion to Dismiss and Response to Show Cause Order (ECF No. 3), which is opposed by Petitioner (ECF Nos. 7 and 8). Petitioner has also filed a Motion for Leave to File Out of Time (ECF No. 6) which shall be granted. No hearing is necessary to resolve the motions pending before the court. See Local Rule 105.6 (D.
