The matter is before the Court on Plaintiffs Warren and Loan Murphy's ("Plaintiffs") First Amended Complaint ("FAC") (ECF No. 43) and Defendant Ocwen Loan Servicing, LLC's ("Defendant") Motion to Dismiss (ECF No. 46) the FAC. The Court's prior order (ECF No. 40) granted Defendant's motion to dismiss the original Complaint, and the material facts in the instant FAC remain the same.
