Presently before the court is defendant Crossmark, Inc.'s ("Crossmark") motion (Doc. 26) for summary judgment and motion (Doc. 34) in limine. For the reasons that follow, the court will grant the motion for summary judgment in part and deny it in part. Additionally, the court will grant Crossmark's motion (Doc. 34) in limine.
