This matter comes before the Court upon Defendant A. Zahner Company's ("Zahner") motion to dismiss Plaintiff's complaint on the basis of the first-filed rule and pursuant to Federal Rule of Civil Procedure 12(b)(6) or, in the alternative, motion to stay the proceedings. (Dkt. No. 9.) Plaintiff alleges the Court has jurisdiction under 28 U.S.C. § 1332 as the amount in controversy is over $75,000...
