National Gear & Piston, Inc. ("Plaintiff") originally filed this suit against Cummins Power Systems, LLC ("CPS") and Cummins Inc. ("Cummins") (collectively "Defendants") in state court in 2010, and Defendants removed it to this Court shortly thereafter.
