This matter is before the court on Defendants' motions to dismiss [DE-23] and Plaintiff's motion to amend [DE-27]. For the following reasons, Plaintiffs motion to amend is ALLOWED, Defendants' motion to dismiss is DENIED WITHOUT PREJUDICE, and Plaintiffs claims against Defendant Giddions are DISMISSED WITHOUT PREJUDICE.
