Plaintiff Keren Matana ("KM") brings this action against defendants J. Ezra Merkin and Gabriel Capital Corporation ("GCC") (collectively, "defendants"). KM invested $1.5 million in Ascot Fund Limited ("Ascot Fund"), an off-shore hedge fund managed by Merkin and GCC. Ascot Fund, in turn, invested substantially all of its assets with Bernard Madoff.
