This cause is before the Court on Defendant's Motion for Partial Summary Judgment (Doc. 49) and Plaintiffs Response in Opposition to Defendant's Motion for Partial Summary Judgment (Doc. 50). For the reasons set forth below. Defendant's Motion for Partial Summary Judgment is GRANTED.
