This matter is before the Court on the defendant's motion to dismiss for failure to state claim [DE 14], plaintiff's motion to appoint counsel [DE 17], and plaintiff's filing of an "addendum" to his complaint [DE 18]. For the reasons stated herein the defendant's motion to dismiss is DISMISSED WITHOUT PREJUDICE and the plaintiff's motion to appoint counsel is DENIED.
