Before the Court is Defendants' Motion to Dismiss Plaintiff's Second Amended Verified Complaint pursuant to Federal Rule of Civil Procedure 12(b)(6). (Doc. 26.) For the following reasons, Defendants' Motion is GRANTED IN PART and DENIED IN PART.
