Plaintiffs filed suit damages seeking damages for injuries allegedly caused by a motor vehicle collision which occurred on June 9, 2009. The Mississippi National Guard (MSNG) seeks dismissal pursuant to the Eleventh Amendment [5]. The Department of Defense also seeks dismissal under the Federal Tort Claims Act [10].
