This cause comes before the Court in consideration of Defendants' Motion to Dismiss (Doc. #48), filed on January 18, 2013. Plaintiffs filed a response in opposition to the motion on January 31, 2013. (Doc. #54). For the reasons that follow, the Motion is granted in part and denied in part.
