MEMORANDUM OPINION
ROSEMARY M. COLLYER, District Judge.
Plaintiffs challenge the validity of the Bureau of Land Management's ("BLM") decision in 2005 to remove a herd of wild horses west of Douglas Creek in Colorado, on the basis that the decision violates the Wild Free-Roaming Horses and Burros Act ("Wild Horse Act"), 16 U.S.C. § 1331 et seq.
