At the final pretrial conference, plaintiff Branch Banking and Trust Company (BBT) and defendants R&T Rentals, LLC (R&T) and F. Rutherford Smith (Smith) agreed to submit this non-jury action for trial solely upon the parties' respective trial briefs without appearance at trial (doc. 64). R&T and Smith did not file their respective trial briefs or provide any defense to BBT's claims...
